WellOlive Terms and Conditions

Based on the Terms and Conditions document, both the official website provided by Kronsoft Development SRL and the Wellolive mobile application can be used by its visitors and users.

These terms govern access to and usage of both the website and the mobile application made available by Kronsoft Development SRL, headquartered in Brașov, Bd Saturn, no. 51, Brașov County, postal code 500440, Romania, email: [email protected], registered at the Trade Registry under no. J08/1537/2007, VAT: RO21878854.

Please carefully read the terms and conditions of use regarding access to the Wellolive website and mobile application, as they apply to any form of use. By accessing the website and installing, registering, and using the Wellolive mobile application, you confirm that you accept these Terms and Conditions of use and the Data Processing Policy.

Without your explicit or implicit acceptance, you cannot use the Wellolive mobile application and/or website.

Kronsoft Development SRL reserves the right to modify the terms and conditions at any time. Such modifications will be deemed accepted upon accessing and using the Wellolive mobile application and official website. Users will always have access to the terms and conditions of use for the application and website by visiting the “Terms and Conditions” page. It is the user’s responsibility to stay informed about the applicable Terms and Conditions of Use and the Privacy Policy.

1. Definitions

Wellolive Mobile Application – a mobile application available in both iOS and Android versions, which can be downloaded by users from the App Store and Google Play, and over which Kronsoft Development SRL holds ownership rights.
Website – the official website of the Wellolive application, available at https://well-olive.app/.
Company – Kronsoft Development SRL, headquartered in Brașov, Bd Saturn, no. 51, Brașov County, postal code 500440, Romania, registered at the Trade Registry under no. J08/1537/2007, VAT: RO21878854, is the rightful owner of the Wellolive mobile application and official website.
Free Content – content available in the Wellolive mobile application and on the website, provided to the user/visitor free of charge.
Paid Content – content in the Wellolive mobile application for which the user/visitor pays a subscription.
Monthly Subscription – a subscription paid monthly, granting the user access to Paid Content.
Annual Subscription – a subscription paid annually, granting the user access to Paid Content.
Usage Fee – the amount to be paid by the user for subscribing to the Basic and Premium plans and accessing all application functionalities.
Contract – this document, including all its amendments.
User – any individual who registers and uses the mobile application, accepting the stated terms and conditions.
Visitor – any individual accessing the mobile application or website without having or creating an account.
Authentication Data – credentials allowing a person to log in to the mobile application, such as email and password or Google account. Passwords are stored encrypted and cannot be viewed in plain text by third parties.
Account – the section in the mobile application that allows the user to access it using authentication data.
Services – all functionalities provided by the mobile application.

2. Creating a User Account

2.1. A user account is created using an email address or Google account. By checking the “I have read and agree to the terms and conditions” box, you consent to your data being used to create a profile, a mandatory condition for using the Wellolive application.

2.2. All mandatory fields regarding email address and password must be completed to create a user account.

2.3. The user is fully responsible for activities conducted through their account and for ensuring the security of their account password and other access data.

2.4. If your account’s security is compromised or you notice any issues, you can contact us at [email protected].

2.5. The company is not responsible for unauthorized or irresponsible use of the account or for any damages incurred by users as a result.

2.6. Kronsoft Development SRL reserves the right to terminate any user account or password at any time if the provisions of these Terms and Conditions are violated, or if there is suspicion of fraud, abuse, or intent to harm Wellolive’s activity or reputation and/or its users.

3. The Contract

3.1. This Terms and Conditions document constitutes the Contract between you as the Beneficiary and Kronsoft Development SRL as the owner of the Wellolive application.

4. Subscription

4.1. The subscription is personal and cannot be transferred to any third party. It is activated in your user account. To qualify as a Beneficiary of the services, you must be at least 18 years old.

4.2. The subscription becomes effective immediately once it is selected in the application, and payment is made and confirmed.

4.3. The fees and types of subscriptions (Basic and Premium), as well as the features included with each subscription type, are displayed in the “Subscriptions” section of the app.

5. Payment

5.1. The usage fees refer to the amounts paid for the Wellolive subscriptions to use the application. These fees become the property of Kronsoft Development SRL and will not be refunded, regardless of whether the user uses the application and its functionalities during the subscription’s validity period.

6. Payment Methods

6.1. Subscription payments are made online via a bank card. You must complete a form with your card information on the secure page of the payment processor. Kronsoft Development SRL does not have access to any card information used for payments, as payments are exclusively processed through these payment processors.

7. Termination in Case of Non-Payment

7.1. If the subscription is not paid (monthly or annually), it will be terminated as of the expiration date of the last paid subscription period. It will not be reactivated unless a new payment is made according to our terms and conditions.

8. Types of Subscriptions

8.1. The Wellolive application offers two types of subscriptions: Basic and Premium which are available for a fee and can be paid monthly or annually.

8.2. Monthly Subscription – The Basic and Premium subscriptions can be paid on a monthly basis.

8.3. Annual Subscription – The Basic and Premium subscriptions can be paid on an annual basis.

9. Changing the Subscription

9.1. The user can switch from a monthly to an annual subscription or from Basic to Premium at any time by paying the corresponding fee. If the user wishes to downgrade from a Premium subscription to a Basic one, this can be done either at the end of the Premium subscription period or during its validity. However, the user will not be refunded for the remaining balance of the Premium subscription.

10. Cancelling the Subscription

10.1. Both Basic and Premium subscriptions can be canceled at any time by the user. For the Premium subscription, cancellation does not entail a refund of the amounts already paid for that subscription, even for periods the user chooses not to utilize.

11. Terms and Conditions for Using the Wellolive Application

The Wellolive application can be used either under a Basic subscription or a Premium subscription, both being under a fee.

Under the Basic subscription, users can access for a fee the following features:

A personalized meal plan with healthy recipes tailored to the user’s profile and goals, including nutritional values, caloric intake, recipe descriptions with ingredients, preparation methods, and macronutrient distribution.
A calculator to monitor caloric intake, abdominal circumference, body mass index, and basal metabolic rate.
Monitoring of key health indicators: weight, blood glucose, oxygen saturation, blood pressure, and body fat percentage.
The ability to generate a medication plan.
A shopping list generator.
Sports activity tracking.
General healthy habit recommendations and tips.

For the Premium subscription, additional features include:

The ability to modify recipes in the personalized meal plan.
A history of health indicator progress.
Personalized healthy habit recommendations, tips, and suggestions.

12. Personal Data Collection

12.1. Wellolive is a lifestyle application (available for both iOS and Android) designed to promote a healthy and balanced lifestyle. It collects personal data from users through profile creation, including personal details (name, surname, email, age, height, weight, gender, date of birth, abdominal circumference, body mass index, basal metabolic rate), health status, lifestyle, medical history, key health indicators (weight, blood glucose, oxygen saturation, blood pressure, body fat percentage), dietary preferences, conditions, intolerances/allergies. This data is used to provide users with personalized diets, create medication plans (if necessary), monitor health indicators, provide information about medications and their interactions (if applicable), suggest sports activities, and recommend good and healthy habits to achieve their goals and track progress.

The legal basis for data processing is Article 6(1)(f) of the GDPR, which pertains to our legitimate interest in providing a functional application.

The collection of data necessary for the app’s functionality and its storage in server-side log files is indispensable for operating the website. Therefore, the user cannot opt out of this data collection.

Personal data such as name, surname, email address, phone number, and home address will be collected from users and may also be used for the execution of certain marketing campaigns. This data is necessary for providing various prizes and rewards to users.

13. Deletion of Data

13.1. Data is deleted as soon as it is no longer needed for the purpose for which it was collected. Obviously, if the user closes their account or deletes their profile, the data will be deleted. However, if the user keeps their account and profile but does not use the Wellolive application for a long period, the data will remain saved. In the case of data collected to ensure the functionality of the application, deletion occurs when the user account is deleted. Storage beyond this period is possible.

14. Force Majeure

14.1. Neither party shall be held responsible for failing to fulfill their contractual obligations if this failure is due to a force majeure event. Force majeure refers to any type of external, unforeseen, and unavoidable event that occurs during the use of the application and the validity of the subscription and prevents partial or complete fulfillment of the obligations assumed by the parties.

15. Right to Compensation

15.1. In case of damages to the users’ property or to the users themselves while using the Wellolive application, the parties agree that Kronsoft Development SRL shall only be liable for such damages if it is proven that they were caused by direct intent or are due to gross negligence by Kronsoft Development SRL.

15.2. In all cases, the compensation borne by Kronsoft Development SRL shall not exceed the value of six Premium monthly subscriptions at the rate applicable at the time the respective damages occurred.

16. Intellectual Property Rights

16.1. The Wellolive application, including all functionalities, graphical elements, and existing content, is owned by Kronsoft Development SRL. The Beneficiary understands that they have no rights over these, except the limited right to install and use the application as described in these Terms and Conditions.

16.2. The application’s name, trademark, trade name, logo, emblem, and slogan are all protected by intellectual property rights.

16.3. The Beneficiary is prohibited from using the image, trademark, logo, emblem, or slogan of Wellolive.

16.4. The application can be downloaded and used exclusively for personal, non-commercial purposes under a monthly or annual subscription. Consequently, it is prohibited to use the application for the following purposes: illegal activities, commercialization, copying, distribution, and transmission without prior written consent from Kronsoft Development SRL; creating or reproducing identical functionalities or the entire application; and reusing and exploiting content for commercialization (including republishing on various websites, online and/or offline platforms).

17. Updating Terms and Conditions

Kronsoft Development SRL, as the owner of the application, reserves the right to modify and update the Terms and Conditions by informing the user without requiring their consent. The services offered, functionalities, content, and fees may change depending on the application’s development strategy. All these updates related to upgrades, new functionalities, error corrections, new services, and pricing policies can be monitored by the user as long as they continuously install the latest versions of the application, which include all updates. Users will always be informed and notified of these updates through all available channels: directly in the application, via email newsletters, social media, and all other online and offline promotion methods.

18. Governing Law and Jurisdiction

The Terms and Conditions of use are governed by Romanian law, and Romanian courts shall have jurisdiction to resolve any disputes arising from the non-compliance and violation of these provisions agreed upon regarding the use of the Wellolive application.

The parties agree that all disagreements regarding the contract or its interpretation, execution, or termination shall be resolved amicably. If an amicable resolution is not possible, the competent courts, as per the law and this document, shall be approached for resolution.

19. User Rights

At any time, the user has the right to unilaterally withdraw their consent regarding the processing, storage, and sharing of personal data by sending a written, dated, and signed request to the email address: [email protected].
